    Website Terms and Conditions of Service (Revised)

    Effective Date: 09/29/2025

    Please read these Terms and Conditions ("Terms") carefully before using our website or engaging our services.

    1. Acceptance of Terms

    By accessing and using the website of Quantum Painting and More (the "Company") and/or requesting a quote or service, you agree to be bound by these Terms and Conditions.

    2. Services Offered

    The Company provides interior painting and a range of home repair and handyman services, which may include, but are not limited to:

    • Painting Services: Interior Painting (Color Change, Touch-Up Painting).
    • Repair Services: Drywall Repair, Mold Remediation, Other General Handyman Repairs.
    • Installation Services: TV Installation/Mounting, Light Fixture Installation, and other minor fixture installations.
    • Property Services: Trash Out / Debris Removal, Turn Key Services (preparing a property for new occupancy).

    3. Service Quotes and Agreements

    a. Quotations: All service quotes provided by the Company are estimates based on the information provided and a visual inspection (if applicable). Quotes are valid for a period of [e.g., 30] days. b. Scope of Work (SOW): The final scope of work, materials, and price will be detailed in a separate, written contract or work authorization (the "Service Agreement") which will supersede any website content or initial quote. c. Changes/Change Orders: Any changes to the agreed-upon SOW after the work has begun must be requested in writing and approved by both parties. This may result in adjustments to the price and/or timeline.

    4. Client Responsibilities

    a. Access: The Client must provide the Company and its personnel reasonable access to the property and work areas during scheduled working hours. b. Preparation: The Client is responsible for removing all valuable, fragile, or sentimental items, as well as clearing the work area of furniture and wall hangings, unless otherwise explicitly detailed in the Service Agreement. c. Utilities: The Client must provide access to water, electricity, and a working restroom for the Company's personnel for the duration of the project. d. Materials: For installation services (TV, light fixtures, etc.), the Client is responsible for providing the fixture, mount, and any specialized hardware, unless the Service Agreement explicitly states the Company will supply them.

    5. Payment Terms

    a. Deposits: A non-refundable deposit of $100.00 may be required before work commences, as specified in the Service Agreement. b. Final Payment: The final payment is due upon substantial completion of the work and the final walk-through, unless otherwise specified in the Service Agreement. c. Late Payment: Unpaid balances may be subject to a late fee of 30% per month, or the maximum rate permitted by law.

    6. Specific Service Disclaimers and Limitations of Liability

    a. Installation Services (TV/Light Fixtures): * The Company assumes the installation site (wall, ceiling, etc.) is structurally sound and that all wiring, electrical boxes, and stud locations are safe, correctly installed, and accessible. * Liability for Damage: The Company is not liable for damage to walls, wiring, plumbing, or internal components caused by hidden or undiscoverable conditions, or where the Client directs the Company to install a fixture in a specific location that proves structurally unsound. * The Company's liability is limited to damage caused by the demonstrable negligence of our personnel during the installation process. b. Drywall Repair: While the Company strives for seamless repairs, older or highly textured walls may show slight variations in finish. Final aesthetic results depend on existing conditions. c. Mold Remediation: * The service is limited to the scope defined in the Service Agreement. We are not mold inspectors. * We cannot guarantee the complete absence of mold spores. Recurrence is possible if the underlying moisture source is not permanently addressed. d. Hidden Conditions (General Handyman): If hidden or unknown physical conditions (e.g., structural damage, asbestos, unknown plumbing or electrical issues) are discovered during any project, the Company reserves the right to stop work. A new Change Order will be required to address the condition or for the Client to hire a specialized contractor. e. Licensing: The Client acknowledges that the Company operates as a handyman service for general repairs and installations. Work requiring a licensed professional (e.g., major electrical panel work, complex plumbing, structural engineering) may be excluded from our scope, and we advise the Client to hire appropriate licensed tradespersons.

    7. Warranty

    The Company warrants its labor and workmanship for up to 30 days from the date of final payment. This warranty is limited and does not cover:

    • Normal wear and tear, or acts of God.
    • Defects or failure of materials, mounts, or fixtures supplied by the Client.
    • Damage caused by Client negligence, abuse, or improper use or maintenance.
    • Damage caused by moisture intrusion, structural shifts, or previous substrate defects.

    8. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina. Any disputes will first be attempted to be resolved through good-faith negotiation, followed by mediation in Cabarrus/Concord, and finally, if necessary, binding arbitration.
